Disclaimer and Terms of Use – Guard Dog Body Armor Ballistic Helmet

1. General Provisions
   This statement governs the terms of sale and use of the ballistic helmet brand Guard Dog (hereinafter "Product") and forms an integral part of the contractual relationship between the seller and the buyer. By purchasing the Product, the buyer confirms that they have read this statement and agree to it unconditionally.

2. Limitation of Use Purpose
   The Product is intended exclusively for personal protection in accordance with its technical designation. The Product must not be used in violation of the laws valid in the buyer’s country. The seller expressly warns that the Product is not intended for military operations unless explicitly stated otherwise and is not certified as military equipment.

3. Disclaimer of Protection Effectiveness
   The seller is not liable for any damage to health, property, or life caused by the use of the Product, even if the Product was used in accordance with its intended purpose. The buyer acknowledges and agrees that no ballistic equipment guarantees absolute protection, and protection effectiveness may vary depending on the type and caliber of ammunition, distance of impact, angle of impact, and other factors.

4. Warranty Limitations
   The warranty covers manufacturing defects only and is valid for 60 months from the date of receipt of the Product. The warranty does not cover:

• damage caused by mechanical damage, shooting, or impact,

• damage resulting from improper handling, modifications, or incorrect storage,

• normal wear and tear of the material.

5. Buyer’s Responsibility
   The buyer declares that they are over 18 years of age and that acquiring and possessing the Product does not violate the laws applicable in the country where they are located or intend to use the Product. The buyer assumes full responsibility for compliance with all laws and regulations regarding the acquisition, possession, and use of ballistic protection.

6. Disclaimer of Liability
   The seller hereby disclaims any liability for harm arising in connection with the use of the Product, especially:

• as a result of improper or illegal use,

• use of the Product in a manner contrary to its intended purpose,

• use in high-risk or extreme conditions exceeding the limits set by the manufacturer.

7. Final Provisions
   By purchasing the Product, the buyer confirms that they:

• have read, understand, and unconditionally agree with this statement,

• are aware of the risks associated with using ballistic protection,

• will make no claims against the seller for damages arising from the use of the Product.

Disclaimer and Waiver of Claims
The seller expressly disclaims any legal liability for:

• injury or death (including fatal injuries),

• property damage,

• psychological harm, loss of income, loss of data, or any other direct or indirect damages,

that may arise in connection with the use, misuse, modification, or other handling of the Product, even if used according to the manufacturer’s instructions or recommendations.

The buyer expressly declares that they waive any claims for compensation or damages that they might otherwise assert against the seller.
